The Ministry of Commerce, Industry, and Investment Promotion of Oman (MoCIIP) has emphasized the necessity of complying with legal requirements in the selection, design, and registration of trademarks. Adhering to these regulations helps preserve intellectual property rights, reduce commercial disputes, and increase consumer trust and fair competition.

Emphasis on the Legal Validity of Trademarks

Engineer Khalid bin Hamood Al-Hunaei, Director of the National Intellectual Property Office at MoCIIP, stressed that building a successful brand begins with confirming its legal validity for registration and protection. He also noted that the ministry continues to strengthen the system for protecting intellectual property rights in Oman and fosters a culture of respect for brand ownership to support local businesses.

Key Trademark Regulations and Restrictions

The current laws regarding trademarks explicitly prohibit certain specific items:

  • Government Symbols and Flags: The law categorically prohibits the use of flags, symbols, or government and international signs, or any imitation of them, to prevent any misleading suggestion regarding government affiliation or endorsement.
  • Geographical Names and Signs: The use of names of various countries or regions is subject to strict regulations to prevent consumer confusion regarding the origin or source of goods and services.
  • Historical Works: Images of castles, fortresses, and historical sites are not absolutely prohibited, but their acceptance depends on whether the overall design implicitly suggests official government support or includes protected elements.

Ghaleb bin Mohammed Al-Saidi, Head of the Trade Department in Musandam Governorate, has urged business owners and designers to conduct preliminary legal research before submitting applications. These initial reviews help identify potential obstacles and prevent wasting time and costs on redesigning brand identity after application submission.

MoCIIP announced that trademark registration in Oman is governed by the Gulf Cooperation Council Trademark Law (Royal Decree No. 33/2017) and the Industrial Property Rights Law (Royal Decree No. 67/2008).

Submitting an application does not mean automatic approval, and all files are subject to thorough review. Once approved, trademarks are published for public objection for 60 days. Approved trademarks are protected for 10 years from the application date and are renewable for similar periods.
