Kuwait's Minister of Justice, Nasser Al-Sumait, announced that the new reforms in the country's civil law are designed to maintain family stability and balance support for family homes with the rights of heirs and co-owners. These changes have been implemented in accordance with the directives of the Emir of Kuwait, Sheikh Mishal Al-Ahmad Al-Jaber Al-Sabah.

Details of the Civil Law Reforms

According to these reforms, courts can postpone the division of residential properties for a specified period based on the request of one of the co-owners, if that property is their only home and they do not have sufficient financial resources to purchase a suitable alternative. Additionally, courts must consider the family and social circumstances of each case.

This support will only be valid in cases where there are reasons for postponing the division. Furthermore, any co-owner can request the termination of this support when the reasons no longer exist. In this case, the court can determine fair compensation for the use of the property to protect the rights of other co-owners as well.

Protection of Heirs' and Co-Owners' Rights

Al-Sumait emphasized that these reforms do not harm the legal rights of heirs or co-ownership. Rather, the aim of this law is to regulate the division of properties while considering the needs of the residents and protecting the financial rights of other co-owners. He stated, "We want to ensure the rights of all individuals are preserved, while a father, mother, or child has legal protection against losing their only home, without infringing on the rights of other heirs and co-owners."

The approved law number 121 was issued on October 19, 2026, and seeks to create a balance between the rights of co-owners for the division of residential properties and human and social considerations.
