Oman's Investment and Trade Court has recently prepared a uniform guide for the processes of commercial and investment disputes. This guide is designed to provide a practical reference for litigants, investors, business owners, and legal professionals to offer accurate and transparent information about judicial procedures and requirements.

Contents of the Guide and Its Objectives

This guide combines judicial and procedural information with the requirements of the business and investment environment, outlining the jurisdiction of the court, levels of disputes, complaint registration procedures, appeals, and the documentation required at various stages. The main objective of this guide is to enhance transparency and access to judicial information, facilitate dispute processes, and improve the experience of stakeholders in commercial and investment judicial services.

Judge Abdullah bin Khalfan Al-Rawahi, Deputy Secretary-General for Executive Affairs of the Supreme Court, emphasized the importance of developing judicial guides for judicial services and dispute processes, stating: "Such guides help clarify procedures, increase operational efficiency, and improve the experience of individuals interacting with the judicial system."

Collaboration Between Entities and Process Facilitation

Nisra bint Sultan Al-Habisi, Director General of Trade at the Ministry of Commerce, Industry, and Investment Promotion, announced that collaboration with the Supreme Court in preparing this guide strengthens efforts to create a business environment characterized by transparency and ease of processes. She added: "This guide increases companies' and investors' awareness of the processes of commercial and investment disputes, gathering pathways for litigation, jurisdictions, requirements, documentation, and related timelines in a single reference."

This guide also contributes to standardizing the understanding of procedures, reducing variability in their implementation, and increasing transparency and access to judicial services. The Investment and Trade Court aims to provide a sustainable legal environment that supports investment and enhances the competitiveness of Oman's economy.

This system also assists in the electronic recovery of company data from the Ministry of Commerce, Industry, and Investment Promotion and information related to parties from relevant government systems. This platform is capable of retrieving individuals' data from the Royal Oman Police Civil Registry, company information, representative data, appeal and execution files.

The guide provides detailed explanations of the electronic complaint registration process, including access to the platform, selecting the jurisdiction, type of complaint and main claim, entering party information, uploading documentation, reviewing the request, and submitting it to the case preparation office. Electronic services include the registration of initial complaints, appeals, and challenges against the commercial section of the Supreme Court, as well as requests, complaints, and requests for suspension of execution.

This guide also includes the required documentation for various categories of disputes, including investment and corporate disputes, checks and invoices, unfair competition, commercial sales, bankruptcy, transportation, representation, insurance, and commercial properties.
